When will the dealer on-line computer system be available to dealers?
Once the new Title and Registration computer system is up and running at the county level, dealers will begin to be given access. Those dealers that are now accessing the TML Titlefile system to obtain motor vehicle records and enter applications will be the first to go on-line to the new system. Dealers will be contacted when the system is ready and training is started.
After dealers go on-line, will there still be a fast title service?
Yes, for out-of-state titled vehicles and repossessions, the dealer will put the application on-line and forward the title work to DMV.
What if an applicant does not have a South Dakota driver's license or want to provide a SSN?
All applications must contain the owner's SD driver's license or SSN or in the case of a company the FEIN. Without it, title and registration must be denied.
When does a seller's permit expire and when is it issued on consigned vehicles?
The seller, upon the sale of the vehicle, will complete the expiration date, which is 30 days from the date of sale, on the permit.
On a consigned vehicle, the seller must provide the buyer with a seller's permit. The expiration date is 30 days from the date of sale of the vehicle. It is recommended that the dealer request the person the vehicle is consigned with to obtain this permit at time of entering into the consignment contract. This will assure that the permit is available at time of sale.
Is the state considering requiring a dealer to collect the 3% motor vehicle excise tax?
No, at this time there is no move to have the dealer collect the 3% motor vehicle excise tax.
If a dealer purchases a vehicle, does a report of sale have to be done by the seller to report the sale to the dealer?
No, a transaction by or with a licensed dealer does not require a report of sale.
Can a dealer issue a hand-written 30-day sold permit after July 1??
Yes, even when the on-line computer system is available to a dealer, the dealer will have the option to issue a permit off of the system or issue a hand-written permit.
Can a dealer title and plate an inventory vehicle?
Yes, in order to do so, the dealer must title and register the vehicle in the dealership name (if a new vehicle, dealer pays excise tax on MSRP and next sale exempt) through the dealership's county treasurer.
If the dealer has titled and licensed a vehicle that is in the dealer inventory in the name of the dealership, should the plates be removed on July 1?
No, only those vehicles offered for sale that are in the dealership inventory (not titled under the dealership name) must have the plates removed from them on July 1.
When a dealer removes license plates from vehicles in their inventory on July 1, 2008, do the plates have to be returned to the county or state?
No, the plates are to be destroyed by the dealer.
Since you will only receive one plate when getting personalized license plates, what will the fees be?
An applicant for personalized plates will pay (both initially and at time of renewal) the registration fee, plus a $25 fee for the special plate.
If a vehicle is abandoned, should the plates be returned before sale of the vehicle?
Yes, the plates should be removed and, if possible, returned to the plate owner.
What fees do penalty and interest apply to?
In addition to a late title application fee ($1 per week up to 25 weeks and $50 thereafter), a person that applies for title and registration beyond the 30-day requirement will be assessed interest against any 3% motor vehicle excise tax owed at a rate of 1-1/4% or $5, whichever is greater, the first month and 1-1/4% for each month thereafter. If application is made beyond 60 days, a penalty fee of 10% against any excise tax owned will also be assessed (one-time fee).
Does a title have to be physically present before a dealer can enter an application on-line?
Yes, once a dealer is required to enter a sales/applications on-line, the title must physically be present before doing so. The dealer will have 15 days from the date of sale to enter the information. If title is not available after the 15 days, a report of sale must be done by the dealer. The application must then be entered immediately upon having the title available. Title must be delivered to purchaser within 30 days of date of sale.
What will a dealer be charged for use of the on-line computer system?
To begin with, a dealer will be assessed a $.25 fee per transaction to query or enter an application on-line.
Can a dealer do a duplicate title application on-line?
Yes, once the system is available to the dealer, an application for duplicate title can be put on the system by the dealer. The paperwork must be submitted to the applicant's county treasurer or the DMV along with the $10 duplicate title fee.
How does plate with owner affect rental company vehicles?
Vehicles that are being rented must be titled in a name separate and distinct from the dealership. The vehicle is titled and registered through the county treasurer in the name of the rental company. When the vehicle is removed from the rental inventory, the license plates are removed. The plates are then eligible, upon title and registration with the county, for attachment to another vehicle.
